We are considering adding a "Repayment Requirement" to our Tuition Aid program. We are wondering how other companies handle this and if this is successful.

1. Do you have a Tuition Reimbursement Repayment Policy for employees who voluntarily terminate their employment? If so, what is the time period (termination within 6 months of receiving reimbursement, 12 months, etc.)?

2. What are the requirements of your repayment policy?

3. How do you administer the collection process for the Tuition Reimbursement Repayment Policy?

4. Are you successful in collecting this money?

Here is our language:

If you voluntarily terminate employment with (company) after completion of the course and prior to completing twelve (12) consecutive months of active employment, you will refund the entire amount of the education expenses provided to you.

If you voluntarily terminate employment with (company) after completion of the course and after completing twelve (12) consecutive months of active employment but prior to completing twenty-four (24) consecutive months of active employment, you will refund a prorated share of the education expenses provided to you. The prorated amount will be based on the total amount of education expenses provided divided by the percentage of time left in months from twenty-four (24) months that you did not continue working. For example, if you receive the maximum of $5,000 for education courses and work only eighteen (18) months after completion of the course, you will refund 50% of the $5,000.00 or $2,500.00 (six (6) months not served divided by 12 months equals 50%).
If any action is brought to enforce any provision of this Agreement by (company), you agree to pay all costs associated with the action as well as any costs of litigation, including all reasonable attorney fees.

This Education Expense Agreement(s) creates no contract of employment between you and (company). You may terminate your employment with this company at any time with or without cause, and (company)may terminate your employment at any time with or without cause.
